Appeal from a judgment of the County Court of Saratoga County (Scarano, J.), rendered November 21, 2008, convicting defendant upon his plea of guilty of the crime of attempted promoting prison contraband in the first degree.

Defendant, a prison inmate, was indicted and charged with promoting prison contraband in the first degree after he admitted to the correction officer who was processing his personal property that he was missing a cellular phone and charger.
