BRETT, Presiding Judge.

Plaintiff in error, Billy Joe Love, defendant below, was charged by information in the District Court of Stephens County, Oklahoma, with the crime of grand larceny by means of the theft of 1,500 pounds of iron pipe thread protectors, valued at $125, in the possession of one Clarence F. Allred. He was tried to a jury, convicted, but the jury was unable to agree on the punishment which the trial court fixed at two years confinement in the state penitentiary.
