The appellant, James H. Leeman, was indicted for malfeasance in office. The indictment charged that he, being judge of the probate court of Logan county, did, on the twenty-second day of April, 1879, and at the April term, 1879, of said court, unlawfully, and willfully and extorsively, charge, demand and receive from one C. E. Wood, the sum of two dollars as a fee for, as such judge, examining and passing upon his account-current as administrator of the estate of H. C. Williams, deceased; “ a greater fee,” it alleged, “ than is allowed by law.”
