These are two indictments which were tried together. The first indictment charged the defendants with maliciously threatening to accuse Patsy D’Alessio of the crime of operating an automobile while under the influence of intoxicating liquor and parking the automobile on the Fresh Pond Reservation without lights, with intent thereby to extort money from him; and the second indictment charged the defendants with conspiracy to commit the crime of extortion set forth in the first indictment.
