dissenting on the question of jurisdiction involved. Not being able to concur in the majority opinion on the question of jurisdiction, I have filed a dissenting opinion as to that. I concur, however, in the majority opinion on the merits.
Inasmuch as the first question which presents itself in this case, is a question of jurisdiction upon which I think the appeal should be dismissed, it will not be necessary to state the general facts of the cause, or to discuss the questions arising thereon.
