This case was removed here by certiorari, from the court of quarter sessions of Cumberland county. Several exceptions have been taken to the proceedings in the court below.
1. The first exception is, that the court of quarter sessions have no authority to lay out a public road in the borough of Newville. The question depends on the construction of the act of assembly of the 26th of February 1817, to incorporate the town of Newville.
