This is a proceeding under the Workmen’s Compensation Act. The plaintiff's are the parents of Van Raymond Warner who died on December 4, 1970, as the result of an accident arising out of and in the course of his employment by the defendant. The sole issue is whether the plaintiffs were in fact partially dependent upon him for support. The Workmen’s Compensation Court and the District Court both found the action should be dismissed.

Van Raymond Warner was 21 years of age at the time of his death. He had been living at home with the plaintiffs. Occasionally, he purchased things for the family…
