“Peter Kleck sued Jesse Kleck and Mrs. Bertha Kleck, alleging that they had conveyed to him by general warranty deed, dated July IS, 1917, certain premises known as lot 4, New City block 7S91, on San Pedro avenue in the city of San Antonio; that the conveyance was made for a cash consideration of $2,000 and the assumption of a note by grantors to Mrs. J. W. Nibel on which there was due $5,009, and the execution and delivery by said Peter Kleck to Jess Kleck of a note for $2,500, payable one year after date, and bearing…
