Solomon, J.), entered May 13, 2009, which, insofar as appealed from as limited by the briefs, in an action alleging, inter alia, that plaintiffs were overcharged for electricity in violation of their leases, granted defendants’ motion to dismiss the first, second and third causes of action of the complaint as against defendant Fisk Building Associates L.L.C. (Fisk), unanimously affirmed, without costs.
