Stanley Coe (defendant) was convicted, following a jury trial, of the class A misde meanor of criminal nonsupport. 1 § 568.040. 2 Defendant was found guilty of failing to provide adequate support for his three children during part of 2005. This court affirms.

Before addressing the merits of this appeal, this court notes the failure of the state to file a respondent’s brief notwithstanding the requirement of § 56.060.1 that:

[i]f any misdemeanor case is taken to the court of appeals by appeal the prosecuting attorney shall represent the state in the case in the court and…
