I. INTRODUCTION

Presently before the court is defendant the United States’ motion for a protective order covering documents generated through peer review at the National Heart, Lung and Blood Institute (“NHLBI”) within the National Institutes of Health (“NIH”). 1 Plaintiff seeks disclosure of documents related to ongoing monitoring of the NIH research protocol in which he participated.
