This appeal was taken, pursuant to the provisions of C.R.C.P. 106(a) (4), from an order of the District Court which upheld a ruling by the Civil Service Commission denying reinstatement of Colonel Benjamin F. Dies to his former position as a member of the Denver Police Department.
At the time litigation was commenced, Colonel Dies sought reinstatement, as well as back pay, which was allegedly owed to him for the period commencing with his application for reinstatement and ending in 1966, when he suffered a stroke. The reinstatement issue is moot, inasmuch as…
