Charles G. Sail, a resident of the state of Minnesota, filed his petition under chapter 118 of the Laws of 1909, page 408 (Rem. & Bal. Code, § 1622 et seq.), praying that he be appointed guardian of the estate of his brother, Neis Oscar Sail, whom he alleged to be an incompetent person. At the time of the application, Neis Oscar Sail was of the age of forty-five years. For several years he had been a resident of the territory of Alaska, where he with two others discovered a group of mining claims in the year 1907.
