ROTH, Circuit Judge:
This case returns to us on remand from the United States Supreme Court. The action was originally brought by James E. Gottshall, a railroad worker, against his employer, Consolidated Rail Corporation (Conrail). Gottshall sought damages under the Federal Employers’ Liability Act (FELA), 45 U.S.C. §§ 51-60 (1988), for negligent infliction of emotional distress.
