DOYLE, P. J.,

An indictment was returned by a grand jury in the district court of Osage county, charging John Brannon, Jack Blagg, and Walter O’Neil with the murder of Pomp Middlebrook, alleged to have been committed on the 23d day of September, 1923. A severance was granted. Upon his separate trial the jury returned a verdict finding the defendant Jack Blagg guilty of murder as charged in the indictment and fixing his punishment at imprisonment in the penitentiary for life at hard labor.
