*585In an action to recover damages for personal injuries, the plaintiff appeals from so much of an order of the Supreme Court, Suffolk County (Underwood, J.), dated September 29, 2004, as granted that branch of the cross motion of Barist Elevator Company which was for summary judgment dismissing the complaint.

Ordered that the order is reversed insofar as appealed from, on the law, with costs, that branch of the cross motion which was for summary judgment dismissing the complaint is denied, and the complaint is reinstated.
