Held, that legal fees paid by petitioners in unsuccessful attempts to limit the condemnation of their commercial orchard property by a public utility district to the taking of a flowage easement rather than a fee simple interest are deductible as ordinary and necessary expenses of such business under sec. 162(a), I.R.C. 1954. L. B. Reakirt, 29 B.T.A. 1296, affirmed per curiam 84 F.2d 996 (C.A. 6, 1936), followed.

Respondent determined the following deficiencies in the petitioners’ Federal income taxes:
