GILBERT, Circuit Judge.

The defendant in error, the St. Louis Mining & Milling Company of Montana, was the plaintiff in an action brought against the plaintiff in error, the Montana Mining Company, Limited, for trespass and conversion of ore which was alleged to have been taken from the plaintiff’s mine by the defendant in the action. The plaintiff in the action owned the St. Louis mining claim, and the defendant owned the Mne Hour mining claim, which adjoined it on the east.
