HUMPHREYS, Judge.

Diation Lamonte Langhome appeals an order of the Circuit Court of the County of Fluvanna finding that he violated the terms of his probationary sentence. For the reasons that follow, we reverse the court’s order.

I. Background

On April 21, 1995, a petition was issued charging Langhorne with malicious wounding, in violation of Code § 18.2-51. Langhorne was born on August 27, 1977.
