Appeal from an order of the Albany Special Term of the Supreme Court which vacated and set aside judgments entered in the Albany county clerk’s office on December 20, 1935, and permitted defendants-respondents to serve supplemental answers and granted a new trial of the action on the ground of newly-discovered evidence. Appellant recovered the original judgments in the Supreme Court of Albany county. (158 Misc. 164.) They were affirmed by this court (254 App. Div. 711) and by the Court of Appeals (279 N. Y. 734).
