SMYTH, Chief Justice.
While appellant’s wife was a patient in the-psychopathic ward of the Washington Asylum and Jail for observation *189as to her mental condition, she committed suicide by hanging. Appellant says her death was the result of the negligence of the District in failing to properly guard and watch over her while she was in the institution. The trial court sustained a demurrer to his declaration, and . from an adverse judgment he brings the case here, for review.
