The motion to dismiss is granted and the petition is dismissed.

Petitioner, a cooperative apartment corporation, commenced this nonpayment proceeding seeking, inter alia, to recover the unpaid balance of rent from July 2006 to the present pursuant to a proprietary lease executed with respondent, a tenant-shareholder of stock allocated to 14 Beech Court, Selden, New York.
