FITZPATRICK, District Judge.

Plaintiff Drew P., through his parents and next friends, brought the above-referenced action under the Education for All Handicapped Children Act (EHCA or the Act), as amended, 20 U.S.C. § 1401 et seq., section 504 of the Rehabilitation Act of 1973 (section 504), as amended, 29 U.S.C. § 794, and 42 U.S.C. § 1983. Plaintiffs contend that Defendant School Board failed to provide Drew P. a free appropriate public education as required by federal law.
