PUTNAM, District Judge.

This suit was filed December 1, 1962, by plaintiff who seeks reinstatement to his former position as an Internal Revenue Agent. Jurisdiction attaches by virtue of Title 5 U.S.C.A. § 1009 and 28 U.S.C.A. § 1361, as amended. Plaintiff’s removal was effected June 15, 1961.

The basis of the complaint is that Section 1986.3 of the Internal Revenue Manual forbids consideration of charges and specifications not presented in the advance notice of proposed adverse action in arriving at the final determination, and that this regulation was *660violated by the Director of Internal…
