— Appellee, Sheffer and Clark, Inc., filed in this cause, on July 26, 1965, an instrument entitled “PETI-TITION TO REMAND FOR SETTING ASIDE AND DISMISSING ACTION,” which petition, omitting formal parts, is as follows, to-wit:
