KRAM, District Judge.
This action is for damages for alleged violations of federal securities law. Plaintiffs initially asserted claims for violation of § 10 b of the Securities Exchange Act of 1934, common law fraud, and breach of the corporate duties of loyalty and due care. By an opinion of April 17, 1989, this Court denied defendants' motion for summary judgment based on the original and first amended complaints. Kuczynski v. Ragen Corp., No. 86-7194 (SWK), slip op.
