The defendant was charged by indictment with the offense of armed robbery. After a trial by jury in the Circuit Court of Jackson County, he was convicted of that offense and sentenced to a term of four years to four years and one day. On appeal defendant contends: (1) the court erred in refusing to give a defense instruction on the lesser included offense of robbery; (2) the court erred in not conducting a suppression hearing outside the jury’s presence when defense counsel objected to the voluntariness of the defendant’s…
