Harvey, J.:

This is an action to recover a bank deposit. A jury was waived, the trial court made findings of fact and conclusions of law, and rendered judgment for plaintiffs. Defendant has appealed. The principal point in controversy is whether the transaction out of *54which the deposit arose was a bank transaction or the individual transaction of an officer of one of the banks.
