This action is prosecuted on behalf of, and in the name of, the State of Oklahoma, on the relation of John L. Gleason, county attorney of Texas county, against the Chicago, Rock Island & Pacific Railway Company, to recover $1,625, as a penalty for failure of said railway company to build and maintain a crossing over a public highway extending along the east line of section 32, township 4 north, range 16 E.
