This case is before the Supreme Court on certified questions from the Court of Civil Appeals for the Seventh district at Amarillo, Tex. The certificate is as .follows:

“The appellants Hatcher and wife borrowed'^,500.00 in July, 1926, from'the appellee Loan Association, executing their note for said sum, secured' by a ’ deed of trust upon certain property in the City of Plainview.
