Appeal from special term, New York county. Application by Louis W. Schultze, one of the coroners of the city of New York, for a mandamus to compel Theodore W. Myers, comptroller of the city of New York, to pay his-salary as coroner. The comptroller refused to pay the salary, upon the ground that the coroner had not paid certain fees, received by him for performing duties as sheriff, into the city treasury, and produced a receipt therefor. Prior to the year 1878 the coroners of the city and county of Hew York were paid for their services by fees, regulated by statute. Por certain of the services rendered the fees were paid by the county of Hew York, and, when called upon to perform the duties of sheriff, they were entitled to receive the same fees as paid for such services to the sheriff, and to be paid in like manner.
