We do not see how the instructions of the court given to the jury in this case can be sustained. The court charged the jury that if the plaintiff had any claim on the defendant for the advances and wagons, &c., made to the defendant on the contract, that they might find a verdict for the same. The suit was brought on a written contract between the parties in which Taylor had agreed to build a house, for Williams, of certain dimensions, and in a certain manner, and have the same completed by the 15th of Juno, 1855.
