MANSFIELD, Circuit Judge:

In this diversity suit for breach of an alleged agreement for the settlement of a number of lawsuits in the Supreme Court of the State of New York Sidney J. Ungar appeals from an order of the district court denying a preliminary injunction restraining defendants from further prosecution of the state court actions or enforcement of any judgment therein and from a judgment dismissing the present suit as against Mandell on grounds of comity. We affirm the denial of injunctive relief, reverse the dismissal of the complaint and remand the case to the district court for…
