In tbe bill of exceptions error is assigned upon the judgment of the trial judge sustaining a demurrer to the plaintiff’s petition in an action for the homicide of her son, alleged to have been caused by the negligence of the defendant in failing to furnish him a safe place in which to work. The allegations of the petition indicate that the homicide occurred by reason of the following facts: that the deceased, a minor, was employed by the defendant as a day laborer in the construction of a certain building, and that'on April 12, 1917, the day of the injury, he and several other…
