Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court at Special Term, entered in Albany County) to review a determination of the State Comptroller, which denied petitioner’s application for retirement benefits in full and without restriction. The facts are not in dispute. Petitioner was employed full time by the Police Department of the City of Syracuse between 1954 and July 6, 1974, when he retired.
