PRELIMINARY STATEMENT

The facts in this controversy are not in dispute. The issue presented is whether the spendthrift provision in The Lois L. Mitchell Trust is valid.

Sec. 541(c)(2) of the Bankruptcy Code recognizes that spendthrift provisions are valid to the extent they are enforceable under nonbankruptcy law and that a debt- or’s beneficial interest acquired from a trust containing a valid spendthrift provision is not property of the bankruptcy estate.
