McGinnis and Matilda, his wife, before a j ustice of Kanawha county to recover the possession of one bay horse, about ten years old, of the value of $100.00, one bay mare of the value of $80.00, and two sets of harness of the value of $15.00, and one hay-ladder of the value of $5.00, and for $200.00 damages for the detention of the same.

The first question in this case is : — What is the meaning and legal effect of the contract between the plaintiffs and defendants, copied in the statement of the case, made by *367them on January 3,1885, in reference to the personal property the subject of this suit?
