delivered the Opinion of the Court.

This is an action for damages caused by an assault and battery. The case was tried in the district court of Lewis and Clark county before a jury, resulted in a verdict for the plaintiff and defendant appeals from the judgment entered ■on the verdict.

From the record it appears that the defendant owns a ranch bordering on what is known as the Stemple Pass road which is a portion of. the highway from Helena to Lincoln, Montana. There are many side roads extending up into the hills since ■the ranch consists of hills, mountain…
