KEM THOMPSON FROST, Justice.

Appellee Friendswood Development Company, Ltd.’s motion for rehearing is granted. The court’s opinion issued on February 12, 2008, is withdrawn, and this Opinion on Rehearing is issued in its place.

This case arises from a contract dispute between a water authority and a development company. When the development company brought suit asserting breach of contract, the water authority asserted governmental immunity from suit. By interlocutory appeal, the water authority now challenges the trial court’s order denying its plea to the jurisdiction.…
