The defendant, Mike Wade, operates an adult establishment in Bradley County under the trade name of Babylon Adult *53Bookstore.1 He submitted an application to the City of Cleveland (“the City”), seeking to establish a second adult book and video store, this one to be located within the city limits of Cleveland.
