This is an appeal from the judgment of the district court rendered against the appellant and in *314favor of the appellee on account of personal injuries alleged to have been received by the latter from falling’ into an excavation for a storm sewer then being constructed. It appears that at the time of the accident appellant, through its contractor, the Commonwealth Construction Company, was engaged in the construction of a storm sewer along West Thirty-third avenue, and near the center of said street in the City and County of Denver.
