Before this court is an adversary proceeding instituted by the plaintiff-debtor Robert Chandler (“Chandler” or “debtor” where appropriate) against defendant Lincoln Capital Corporation (“Lincoln”) and Michael Ira Asen (“Asen”) to determine the validity of and obtain a declaratory judgment relating to a mortgage purportedly held by Lincoln on the debtor’s home in Bellmore, New York (the “Property”). The mortgage is dated May 17, 1982 and is in the principal amount of $107,000. The debtor withdrew the action as against Asen on the second day…
