The appellant, John Hansford, was tried and convicted in the Whitley circuit court under an indictment charging him with the crime of false swearing, his pun*701Ishment being fixed by verdict of the jury and judgment of the court at confinement in the penitentiary not less than one year nor more than a year and one day.
