-This is an action to recover a salary. Tbe case was referred to a referee wbo, in bis report, recommended that judgment be entered in favor of plaintiff; and against tbe defendant in tbe sum of $413.97, with interest. Plaintiff filed bis exceptions to tbe referee’s report, wbicb were overruled, and judgment was entered in accordance with tbe report. Plaintiff filed a motion for a new trial wbicb was likewise overruled. Thereafter, tbe amount of tbe judgment was paid to the clerk of tbe court by tbe defendant and tbe same was received by tbe plaintiff and tbe judgment was satisfied upon tbe…
