Woodward, Deputy Attorney General,

—We have your request for a formal ruling as to the place in which a convict, who has been found guilty of *661murder in the first degree and sentenced to death by electrocution, shall be kept in custody after the sentence has been imposed, and until penalty of death has been inflicted.

You state that in years past in some cases the prisoner has been held in the county jail until such time as the sheriff has been directed to read the formal death warrant to the prisoner, after which he has been removed to the Rockview branch of the Western State Penitentiary. You…
