Order for summary judgment: This cause came on for hearing upon the written stipulation and the motions of the plaintiff and of the defendant Department of Revenue of the state of Florida, for summary judgment. The court was advised that the defendant Aetna Insurance Company agreed that hearing on plaintiff’s motion for summary judgment might proceed provided it was first dis*176missed as a party defendant.
