The claim of appellant that he made the alleged contract of purchase with the defendant is based upon two orders sent from Milwaukee, Wisconsin, where the plaintiff’s place of business was, to Mr. Mertz at Jacksonville, Florida, in May and June, 1894. Mr. Mertz was employed by the defendant as a traveling agent from 1890 until 1896. Prior to 1894 he called upon the plaintiffs' and took orders from them for goods such as are sold by defendant; these orders were filled by the defendant.
