— The Township of Derry, Dauphin County, Pa., and the Derry Township School District, plaintiffs herein, instituted an assumpsit action against Edward S. Swartz and Helen R. Swartz, his wife, trading as Indian Echo Caverns, defendants herein, seeking payment of taxes imposed upon amusements in said Derry Township. Defendants filed prehminary objections to the complaint which are presently before the court for disposition.
