Error to district court, Johnson county. Suit by the Powder River Cattle Company against the board oí county commissioners of Johnson county to recover back certain taxes paid by plaintiff. Judgment for defendant county on its demurrer to the petition. Plaintiff brings error.

This suit was brought in the district court for Johnson county by the plaintiff in error against the defendant in error to recover back taxes, and the penalty accruing thereon, in the sum of $5,832.64, levied and collected for the year 1886, and interest thereon from the date of payment, December 22, 1886. The defendant in error demurred in said court to the petitions, original and by way of amendment, on the ground that they do not state facts sufficient to constitute a cause of action.
