This is a proceeding in rem, instituted in this Court at the March Term, 1867, by the District Attorney, “ who prosecutes for the United States and an informant,” to confiscate and condemn certain real and personal property situate in Clark county in this district, and known as the “Athens Armory.” The information contains four counts: three are founded on the Act, entitled, “ An Aet to confiscate property used for insurrectionary purposes.” Approved August 6, 1861. 12 Stats. 319 ; and the fourth, on the Act, entitled, “ An Act to suppress insurrection, to punish treason and rebellion, to…
